Consumers are you and me. We buy things and “consume” them. This is not limited to eating food. Everything you buy at a mall is a consumable. Consumer laws have been passed by every state and the federal government. Government consumer laws govern production of food, prescription drugs, automobile manufacturers, tobacco, and just about everything. Class action lawsuits have been filed under consumer protection laws.
However, our focus is on consumer law as it relates to the right of consumers to seek legal recourse in state and federal court. Every jurisdiction has enacted consumer protection acts that provide specific remedies against companies that make false promises, mislead, lie, cheat and steal their way to more profit.
The Ogletree Abbott Law Firm is a consumer law firm and we have the knowledge, experience and resources to pursue all consumer cases. Our typical consumer case usually involves a defective baby crib or playground equipment but we have also been involved in litigation involving harmful prescription drugs and medical devices. There is a long list of recalled items (including Toyotas) that keep lawyers in our line or work, busy. It’s a shame that we have to spend so much time forcing companies in this country to stop making defective and dangerous items to sell to American consumers.
Sometimes the harm is only to the product but the horror comes in when the harm is to a baby or to a family riding in their SUV. You can’t imagine what we see and go through with regular folks. The worst thing however, is that many times, manufacturers go forward with making and selling products that they know are dangerous, just to make a profit.
Any prejudice you may have against trial lawyers would vanish in a heartbeat if you were sitting on a jury when we present evidence of automobile gasoline tanks bursting into flames upon a rear-end collision just because a manufacturer put it into commerce, knowing full well that the dangerous defect existed when they put it on the market. They even had their own engineering reports warning them that they were selling a dangerous product, but they hid the reports to make an extra dollar.
The next time you hear of a person who has suffered an injury due to any product, think of us. We think about our clients everyday and worry about who will walk into our office the next day with another tragedy.
We can’t get someone’s loved one back or remove physical and emotional scars but we can take legal action to stop this type of behavior by corporate America. We can also force at-fault companies to pay for medical bills, lost wages, disability, prosthetics, prescription medication and all of the other damages that result from a serious injury.
