Accutane Lawsuit Information

The harmful side effects of Accutane are very real. And since you are reading this, there is a good chance that you or a loved one may have experienced one or more of them. If so, you have come to the right place. But what you need to know right now is this: we here at the Ogletree Abbott Law Firm are standing by ready to help you in any way we can—be it by simply providing you with this helpful information or acting as your Accutane lawyer.

What is Accutane?

First approved by the FDA in 1982, Accutane (also found in the generic isotretinoin) is a powerful prescription drug originally intended to treat those with severe acne problems. This drug was not meant to be prescribed for moderate acne cases, but instead as a “last straw” sort of option. It works by inhibiting oil gland secretion, thereby reducing the occurrence of unsightly acne.

What is the Problem with Accutane?

The problems are numerous and serious—potentially fatal. First of all, the product presents an unnecessary risk to unborn babies. Accutane has been proven to increase the risk of birth defects. Some deadly. In other words, if you took the drug during pregnancy, you need to speak to an Accutane lawyer.

More recently, it was found that Accutane is the cause of severe bowel disorders. These include:

  • Crohn’s Disease—A type of inflammatory bowel disease that produces open sores in the small and large intestines. It can also negatively affect the rectum.
  • Ulcerative Colitis—This bowel disorder causes ulcers beginning at the rectum up into the lower portion of the large intestine.

Other serious illnesses that have been linked to Accutane include:

  • Hypertension
  • Hepatitis
  • Pancreatitis
  • Liver Damage

There are also a host of less serious side effects, which range from hair loss to back pain to severe depression and blurred night vision.

Accutane Recall

The FDA made their first move to protect Accutane users by forcing Hoffman-LaRoche to place a warning on all their products. This warning was aimed at pregnant mothers to let them know the product would pose a very real threat of birth defects in their unborn children.

Finally in June of 2009, Hoffman-LaRoche to made the right move and pulled their Accutane products off the market. They did so in the face of countless lawsuits from aggressive Accutane recall attorneys. However, for many unsuspecting victims, this action was “too little, too late.”

The first lawsuit was presented to the courts in 2010. The plaintiff was Andrew McCarrell. The problem? After years of dealing with terrible acne, he tried the “miracle drug,” Accutane. And while it did wonders for the skin condition in his 20s, it also did something else—it caused him to develop irritable bowel syndrome later on. The result? 5 surgeries and colon removal.

McCarrell’s Accutane attorneys claimed that Hoffman-LaRoche did not adequately warn users of this potential side effect. The jury bought it and McCarrell walked out of the courtroom with approximately $25 million thanks to the hard work the attorneys did.

While we did not represent McCarrell, we are currently taking on similar Accutane lawsuits. If his situation sounds similar to your own, we can help. Please be aware, the drug is still available under the generic form from various other manufacturers. Take strong precaution before ever considering taking the drug.
