Personal Injury

Personal Injury refers to injuries to people usually from accidents but also included are injuries from defective prescription drugs, medical malpractice and all other injuries, diseases or medical conditions that result from the negligence of any person or company. The word "personal" also applies to accidents, injuries and diseases suffered by those other than yourself. A better term would be "bodily injury". An injury or the death of a family member would certainly be included within the use of the term "personal injury."

The term "negligence" comes from the word "neglect" and conveys the meaning that a person or company has been neglectful in their duty to act or perform reasonably. If a person or company fails to perform to the standard of a reasonable person or company, they can be held legally responsible for their injuries and damages. Intentional conduct is worse than negligent conduct and companies and individuals can be held liable for punitive damages if there conduct was intentional or "grossly" negligent. For example, a prescription drug manufacturer is legally expected to obey all federal and state laws regulating their business and they are expected to do the same testing and reporting as other drug manufacturers. However, when drug manufacturer skips part of the process to save money or withholds drug warnings to sell more products, they can be held legally liable for resulting injuries, diseases and damages.

If anyone in your family has suffered an injury, disease or death, you should not attempt to determine if someone was negligent because that is the job of a lawyer. If someone you know has suffered an injury, disease or death you should contact a lawyer and determine if you have the right to recover from a negligent company or person. It's not just about money, it's about holding people and companies responsible and accountable for bad acts.
